程式使用條款
1. 總則閣下安裝本程式(見下列定義)， 即表示閣下同意以下使用條款(程式條款)約束。閣下安裝和/或接收本程式前，請先詳閱程式條款。
2. 定義本程式指由Play4Act Studio(下稱P4A) 推出，提供Bw+ App服務並應用於運行iOS / Android系統裝置上的應用程式，包括本程式的不時更新，以及所有令本程式可被使用的軟件或文件。
3. 資料保護閣下因使用本程式而向P4A 提供的任何個人資料，只會由P4A 根據私穩政策使用。有關政策已刊載於此網頁:https://chiangkaiyun.wixsite.com/play4act/
4. P4A 網站本程式容許閣下使用P4A 網站的部分功能。當閣下使用此等功能時，將受P4A網站的使用條款約束。有關使用條款已刊載於此網頁:https://chiangkaiyun.wixsite.com/play4act/
5. 專利權及授權
5.1 本程式內所有商標、版權、資料庫使用權及其他任何性質的知識產權，以至本程式的原始程式碼，均由P4A 直接持有。
5.2 P4A 謹此授權閣下個人按照程式條款使用本程式。此權利為全球性、非獨有性、免付版稅及可被撤回。
6. 使用條件
6.1 閣下不會進行，亦不容許第三者以閣下名義進行(i) 復制本程式並將副本加以分發；(ii) 試圖復制、重建、修改、修飾、進行逆向工程、分柝、反編碼、傳輸、交換或翻譯本程式；或(iii) 制造本程式任何類型的衍生物品。
6.2 本程式目前僅供閣下個人免費使用，不得作商業用途。 P4A 保留權利隨時及以任何理由修改及撤回本程式，或就使用本程式或享用本程式所提供的服務，按程式條款規定向閣下收取費用。
6.3 閣下與流動網絡供應商所簽訂的合約條款，閣下同意於使用本程式時將繼續適用。因此，閣下在接通網絡使用本程式期間，或將被該流動網絡供應商收取網絡連接費用或其他第三方費用。閣下同意自行承擔此等費用。
7. 遙距攞票/訂座/外賣/優惠卷服務
7.1 P4A 有權不事先通知你的情況下，暫停服務或其他任何部份，以作維修、保養、更新或其他P4A 認為適合的工作。
7.2 本程式所記錄閣下的個人使用資料如蒐藏喜愛活動訊息、不會將資料販售給他人。
7.3 本程式有使用追蹤服務，如Google Analytics等，僅用於統計程式使用度、問題，採不記名方式蒐集資料。
8. 可用性
8.1 本程式適合於裝有iOS / Android 系統的手持電話裝置上。 P4A 將合理地作出努力，讓本程式於任何時候均可使用。然而，閣下亦同意本程式乃經互聯網及移動網絡提供，其品質或可用性將受外界因素影響，而P4A對此等因素未必能合理地控制。
8.2 當本程式無法使用、內容無法或難以下載或使用，或因通訊系統固障令本程式無法使用時，P4A、其Studio相關人員、開放資料源台北市政府、以至活動承辦商，均不會承擔任責任。
8.3 使用本程式或遙距攞票功能不會提供座位保證。
9. 系統要求
9.1 閣下必須擁有兼容及有上網功能的流動電話，並符合最基本的規格要求(軟件要求)，方能使用本程式。
9.2 該等軟件要求如下: 運行iOS 12.2 或以上、Android 9.0 API 28.0或以上，市面上流通販售的行動電話。
9.3 該等軟件要求，或將不時升級，以支持新功能及新服務。
10. 終止P4A 可隨時向閣下終止本程式的使用。
11. 責任限制
11.1 閣下使用本程式而引起的一切直接、間接、特別、懲罰性、示範性或連帶性損失或賠償，包括利潤或相關損失，不論是否由任何一方蓄意造成，不論是否根據違反協議、侵權行為(包括疏忽)、產品缺失或其他原因，P4A 概不負責。
11.2 閣下如因安裝或使用本程式而導致設備遭受破壞或變更，包括但不限於電腦設備、手持裝置或流動電話，P4A 概不負責。
11.3 程式條款內的任何規定，不能豁免或限制P4A因疏忽、欺騙或欺詐性闡釋而引致的人員死亡或受傷而須負擔的責任，或在適合法律下不能豁免或限制的任何其他責任。
12. 免責條款及保證在法律最大程度的容許下，P4A 謹此聲明並不承認有關本程式的所有默示保證。本程式及軟件以(原狀)及時(原樣)提供，不包括任何形式的保證。
13. 其他事項
13.1 協議闡釋:條文的標題和例子僅供參考，以幫助用家操控及明白此等條款，並不構成條文的定義，或限制條文的適用範圍。
13.2 管轄法律:此協議在任何情況下均受台灣地區法律管轄。
13.3 無效規定:如本協議的任何規定被視為無效或不可執行，該規定應被移除，而余下的規定將繼續生效。
13.4 未棄權:若閣下或其也人士違反協議而我們並不追究，並不表示我們放棄追究嗣後或類似的違反協議行為。
13.5 轉讓:我們有權轉讓本協議下我們的權利和義行(包括當中的使用條款)，而閣下無權轉讓本協議下閣下的權利和義務。
13.6 完整協議:本協議訂定我們和閣下之間，就有關此協議主題事宜達成的完整理解及協議。 13.7 一切條款以中文版本為準。

Mobile app Terms and Conditions
1. GENERALBy installing the application (defined below), you agree to bound by these terms of use (“Play4Act Studio”).Please review them carefully before installation and/or acceptance.
2. DEFINITIONS "Bw+" shall mean the software provided by Play4Act Studio (“P4A”) to offer services related to the merchant, to be used on iOS / Android devices and any upgrades from time to time and any other software or documentation which enables the use of this app.
3. DATA PROTECTIONAny personal information you supply to P4A when using Bw+ will be used by P4A in accordance with its Privacy Policy which can be viewed at https://chiangkaiyun.wixsite.com/play4act/
4. P4A WEBSITE
P4A allows you to access certain functionality available onhttps://chiangkaiyun.wixsite.com/play4act/ Such access will be governed by the https://chiangkaiyun.wixsite.com/play4act/ website Terms of Use.
5. PROPRIETARY RIGHTS AND LICENSE
5.1 All trademarks. copyright, database rights and other intellectual property rights of any nature in Bw+ together with the underlying software code are owned either by P4A or by P4A’ licensors.
5.2 Bw+ hereby grants you a worldwide, non-exclusive, royalty-free revocable license to use Bw+ for your personal use in accordance with these Bw+.
6. CONDITIONS OF USE
6.1. You will not, nor will allow third parties on your behalf to
(i) make and distribute copies of Bw+
(ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate Bw+; or
(iii) create derivative works of Bw+ of any kind whatsoever.
6.2 Bw+ is currently make available to you free of charge for your personal, non-commercial use. P4A reserves the right to amend or withdraw Bw+, or charge for the application or service provided to you in accordance with these Bw+, at any time and for any reason.
6.3 You acknowledge that the terms of agreement with your respective mobile network provider (‘Mobile Provider’) will continue to apply when using Bw+. As a result, you may be charged by the Mobile Provider for access to network connection services for the duration of the connection while accessing Bw+ or any such third party charges. You accept responsibility for any such charges that arise.
7. ONLINE QUEUING / RESERVATIONS / TAKEAWAY / ECOUPON SERVICE
7.1 P4A reserves the right to suspend this service or any parts of the services for repairs, maintenance, upgrades or any other work P4A deems appropriate without prior notice.
7.2 Bw+ will ask users to provide personal information such as telephone and email address for identification purposes.8. AVAILABILITY
8.1 Bw+ is available to handheld mobile devices running iOS / Android Operating Systems. P4A will use reasonable efforts to make Bw+ available at all times. However you acknowledge Bw+ is provided over the internet and mobile networks and so the quality and availability of Bw+ may be affected by factors outside P4A’s reasonable control.
8.2 P4A and its group of companies and sub-contractors do not accept any responsibility whatsoever for unavailability of Bw+, or any difficulty or inability to download or access content or any other communication system failure which may result in Bw+ being unavailable.
8.3 The use of Bw+ and /or it online queueing features does not provide guarantee of availability of seating.
9. SYSTEM REQUIREMENTS
9.1 In order to use Bw+, you are required to have a compatible mobile telephone or handheld device, internet access, and the necessary minimum specifications (‘Software Requirements’).
9.2 The Software Requirements are as follows: iOS 12.0 or above, Android 9.0 API 28.0 or above.
9.3 The version of Bw+ software may be upgraded from time to time to add support for new functions and services.
10. TERMINATION
P4A may terminate use of Bw+ at any time without giving notice of termination to you.
11. LIMITATION OF LIABILITY
11.1 In no event will P4A be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of your use or access to Bw+, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise.
11.2 P4A is not liable to you for any damage or alteration to you equipment including but not limited to computer equipment, handheld device or mobile telephones as a result of the installation of use of Bw+.
11.3 Nothing in these Bw+ shall exclude or limit P4A’s liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation or any other liability which cannot be excluded or limited under applicable law.
12. DISCLAIMER OF WARRANTIESTo the maximum extent permitted by law, P4A hereby disclaims all implied warranties with regard to Bw+. Bw+ and software are provided “as is” and “as available” without warranty of any kind.
13. MISCELLANEOUS
13.1 Interpretation of Agreement; Clause headings and examples are provided for reference purposes only to assist in navigating and understand these Terms and Conditions. They are not intended to define, or limit the scope or extent of any clause.
13.2 Governing law: This Agreement shall governed in all respects by the laws of Taiwan.
13.3 Invalid provisions: If any provision of this Agreement is held to be invalid or unenforceable, that provision shall be struck out and the remaining provision shall be enforced.
13.4 No Waiver: Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
13.5 Assignment: We may assign our rights and obligations under this Agreement (including any incorporated Terms and Conditions. You may not assign your rights and obligations under this Agreement).
13.6 Entire Agreement: This Agreement sets out the entire understanding and agreement between us with respect to its subject matter.
